Terms of Service

The Terms of Service ("Terms of Service" or "TOS") constitutes the agreement between LoudClear and its telecomm service providers and the user of Loudclear or of any of our products. In this agreement, LoudClear is referred to as "we", "us", "our", "LoudClear.com" or "LoudClear", and the user is referred to as "you", "your", "user", or "customer".


1. Services Provided
LoudClear offers customers the abiliity to make international long distance calls on cell phones/landline phones(touch tone) by using local access/toll free access numbers and Personal Identification Numbers (PINs).


2. Services NOT Provided
LoudClear does not provide any emergency call (911) services. For any life threatening calls, you must contact your own cell phone/landline phone service provider. Top


3. Usage of Website and PINs
Any abuse of the website, reverse engineering of PINs, are prohibited. LoudClear does not allow any illegal usage of the website, or sold PINs.


4. Customer Credit Reference
LoudClear reserves the right NOT to provide service to customer with bad credit based on Loudclear's solely discretion.

5. Right to Revoke
LoudClear reserves the right to discontinue or revoke our service at any time without prior notice, if we find any payment transaction problem, or any suspecious activity on our website.

6. Rates/Surcharges
Rates are subject to change without notice. LoudClear or its telecomm partners do not charge surcharges, except for the 95 cents surcharges mandated by FCC, on public payphone.

7. PIN Delivery
PIN delivery shall be instant. Under certain circumstances, due to network speed or other factors, PIN delivery may take more than 10 minutes. If Customer does not get PIN within ten minutes after payment is completed, customer should write to support@loudclear.com

8. Billing Question
All billing quesions should be sent to support@loudclear.com first, before you querry your bank or credit card company. If you want to dispute any LoudClear charges on your statement, you must notify LoudClear within sixty (60) calendar days after you receive your statement from your bank or credit card issuer.

9. Refund
Due to the nature of the business, Loudclear does not refund sold pins. However, if you really have technical difficulties to use your pin, you can write to support@loudclear.com asking refund. This has to be on per case basis.

10. Charges from Customer's Cell Phone or Landline Phone Service Provider
When using service/products from Loudclear, customer shall follow the exact procedure. LoudClear is not responsible for any charges by customer's cell/landline provider. Whenever you use your pin, you will always have to dial local access number or toll free access number first. We strongly recommend that you cancel your international long distance calling plan on your cell phone/landline phone, to avoid potential accident.

11. Customer Privacy
LoudClear does not share customer's information with any third party for any commercial purposes. If we believe that you have used our service/products for an unlawful purpose, we or our telecomm partners may forward the relevant communication and other information, including your identity, to the appropriate authorities for investigation and prosecution. You consent to our forwarding of any such communications and information to these authorities.

12. No Warranties on Quality of Service
We make no warranties, express or implied, including but not limited to, any implied warranties of our service or products for a particular purpose, title or non-infringement or any warranty arising by usage of trade, course of dealing or course of performance. In addition, we do not warrant that the service will be without failure, delay, interruption, error, omission, degradation of voice quality, or loss of content, data, or information. Neither LoudClear nor its officers, directors, employees, affiliates or agents, or any other service provider or vendor who furnishes services, or products to the customer for our service will be liable for unauthorized access to our or your transmission facilities or premises or equipment or for unauthorized access to, or alteration, theft, or destruction of, customer's data files, programs, procedures, or information through accident, fraudulent means, devices, or any other method, regardless of whether such damage occurs as a result of LoudClear's or its service provider's negligence. Statements and descriptions concerning our service or products, if any, by LoudClear or Loudclear's agents are informational and are not given as a warranty of any kind. LoudClear will not give you credit for any interruption of Loudclear service or service from LoudClear's telecomm partners.

13. Legal Age
You promise that you are of legal age to enter into this agreement and that you have carefully read and fully understand its terms and conditions.

14. Customer Service
LoudClear staff replies customers email, addressed to support@loudclear.com, within 60 minutes after email is received. However, there is no garantee that email will be replied within 60 minutes. Sometimes, in the afternoon especially, it can take upto 8 hours or even more.

15. Lost/Stolen PIN
Loudclear is not responsible for any lost or stolen pin, or any customer privacy issues incurred by lost/stolen pin.

16. Explicitely prohibited usage on internet phone
LoudClear explicitely prohibits customers to use any of LoudClear's cards on any internet phone, which includes, but is not limited to, google voice, skype. Customers use internet phone at their own risk. Internet phone, quite often, does not show its owner's real phone number. That can cause misusage, minute loss, misunderstanding and distrust.

17. Settlement of Disputes
This TOS provides for settlement of disputes by our CapCompensation Policy as set below, instead of jury trials.

18. CapCompensation Policy
Our customer servcie department can resolve most customer concerns quickly to the customer's satisfaction. If you have a dispute or claim against us, you should first contact our customer service department by email at support@loudclear.com. In the event your dispute or claim is not resolved to your satisfaction, the final maxium compensation from LoudClear is the original price you paid for the specific product.

19. Revisions to TOS
From time to time LoudClear may make revisions to these Terms of Service, or our Privacy Policy. LoudClear shall provide notice of such revisions, if any, by posting revisions on LoudClear.com, or sending an email to the email address registered by customer. Customer agrees to visit our website periodically and to check your registered email to review any such revisions. You also agree to notify us immediately of any changes to your email address. By continuing to use our services after revisions are effective, you accept and agree to abide by those revisions.
